Terms and Conditions for Moim

Welcome to Moim!
These Terms and Conditions ("Terms") govern your access to and use of the Moim mobile application, website, and services (collectively, the "Service") provided by Heyjaws ("Company," "we," "us," or "our").
Please read these Terms carefully. By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
1. Definitions
"Service": The Moim application and all related services provided by Heyjaws.
"User", "you", "your": Any person who creates an account and uses the Service.
"Content": Any text, graphics, images, music, software, audio, video, information or other materials that Users post, upload, publish, submit, or transmit to be made available through the Service.
"Moim": An online or offline social gathering, event, or meeting created or joined by Users through the Service.
"Community Post": A listing, notice, article, or any other Content posted by a User on the neighborhood community board feature of the Service.
2. Eligibility and Account Registration
You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.
When you create an account, you agree to:
a) Provide accurate, current, and complete information.
b) Maintain and promptly update your account information.
c) Maintain the security of your password and accept all risks of unauthorized access to your account.
d) Promptly notify us if you discover or otherwise suspect any security breaches related to the Service.
3. The Moim Service
The Service is a platform that enables Users to:
a) Create, find, join, and manage social gatherings (Moims).
b) Post, view, and interact with Content on a location-based neighborhood community board (Community Posts).
4. User Conduct and Responsibilities
You agree that you will not, and will not permit any third party to, do any of the following:
a) Use the Service for any illegal, fraudulent, or unauthorized purpose.
b) Post any Content that is defamatory, obscene, pornographic, vulgar, offensive, or that promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group. This includes any content that is insensitive or offensive on the grounds of religion, race, ethnicity, gender, or sexual orientation.
c) Violate, or encourage any conduct that would violate, any applicable law or regulation in Malaysia.
d) Harass, threaten, stalk, or intimidate other Users.
e) Post any commercial advertisements, spam, or unsolicited promotions without our prior written consent.
f) Impersonate any person or entity or misrepresent your affiliation with a person or entity.
g) Use the Service to organize or facilitate any prohibited activities, including but not limited to, illegal gatherings, gambling, prostitution, or the sale of illegal goods and services.
h) Interfere with or disrupt the integrity or performance of the Service.
5. User-Generated Content
You are solely responsible for all Content that you make available through the Service. You represent and warrant that you own all your Content or you have all rights that are necessary to grant us the license rights in your Content under these Terms.
By making any Content available through the Service, you grant to Heyjaws a non-exclusive, transferable, sub-licensable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform, and distribute your Content in connection with operating and providing the Service.
We are not obligated to monitor access to or use of the Service or to review or edit any Content, but we have the right to do so for the purpose of operating the Service, to ensure compliance with these Terms, and to comply with applicable law. We reserve the right, but are not obligated, to remove or disable access to any Content, at any time and without notice, if we, at our sole discretion, consider it to be objectionable or in violation of these Terms.
6. Moims (Offline Meetings and Events)
The Service is a neutral platform. We are not a party to, and do not have any control over, the interactions between Users. You acknowledge and agree that you are solely responsible for your interactions with other Users, both online and offline.
a) Assumption of Risk: Attending a Moim is at your own risk. We do not conduct background checks on or screen our Users. We encourage you to use caution, common sense, and to take appropriate safety precautions when interacting with other Users or attending a Moim.
b) No Liability: You agree that Heyjaws is not responsible for and will not be liable for any loss, injury, claim, or damages (including but not limited to personal injury, theft, or property damage) arising out of or in connection with your attendance at a Moim or your interactions with other Users.
c) Release: You release Heyjaws, its officers, directors, employees, and agents from any and all claims, demands, and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with any disputes between you and other Users.
7. Neighbourhood Community Posts
The community board is a platform for local communication. We do not verify or endorse the Content of Community Posts. You are solely responsible for your interactions and any transactions you may enter into with other Users through the community board. We strongly advise you to exercise caution and diligence. Heyjaws is not responsible for the truthfulness, accuracy, or legality of any Community Post.
8. Termination
We may, in our sole discretion, suspend, disable, or terminate your account and your right to access the Service at any time for any reason, without notice, if you violate these Terms. You may terminate your account at any time by using the account deletion feature within the Service. Upon termination, all licenses and rights granted to you in these Terms will immediately cease.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
Heyjaws makes no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HEYJAWS, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
11. Indemnification
You agree to defend, indemnify, and hold harmless Heyjaws and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party.
12. Governing Law and Dispute Resolution
These Terms and any action related thereto will be governed by the laws of Malaysia without regard to its conflict of laws provisions. The exclusive jurisdiction for all disputes, claims, or controversies arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Service will be the courts of Malaysia, and you and Heyjaws each waive any objection to jurisdiction and venue in such courts.
13. Changes to Terms
We may modify these Terms at any time. If we make material changes, we will provide you with notice, such as by sending an email, notifying you through the Service, or by updating the "Effective Date" at the top of these Terms. By continuing to access or use the Service after those changes become effective, you agree to be bound by the revised Terms.
